Appendix: Speeches and Trials

I. Speeches and trials mentioned in De oratore

The list given below contains every speech or trial mentioned in De oratore; they are arranged in order of appearance, and subsequent references to the same speech or trial are listed under their first appearance. Trials, although in some cases more than one speech is discussed, are listed as single events; somewhat inconsistently, multiple speeches given in the same senate meeting or public assembly are listed separately, because they are in general distinguished by Cicero. This applies particularly to the last senate meeting before Crassus’ death, within which Cicero distinguishes three speeches. The number of question marks and expressions of uncertainty in this list indicate that it represents an approximation and that the conclusions drawn from it (in Chapter 3, in particular) are also approximations: the numbers of various kinds of speeches, and even the identification of particular speeches, trials, and speakers are probable rather than certain. In the identification of just what kind of event is being described, Caesar Strabo’s discussion of humor poses particular difficulties: because he is reporting jokes, not arguments, it is not always easy to tell whether he is referring to a speech or simply reporting a conversational anecdote, nor is it always possible to be certain whether multiple jokes involving the same person come from the same speech. My judgment in such cases is not always the same as that of other scholars, and I have generally avoided combining separate jokes in order to construct a single speech. Aside from funny stories that seem to refer to conversational exchanges rather than speeches, I have also excluded two possible items:

a)The third—or second-century problem of the citizenship of Publicius Menander (1.182, although unnamed here; cf. Cic.Balb. 28 and Dig. 49.15.5.3); this was resolved by legislation, not a trial, and no speech is connected with it.

b)the quotations from Crassus’ speeches on the colony of Narbo and the lex Servilia (2.223); they are quotations within a quotation from the speech of M. Iunius Brutus against Crassus (see #30 below) and are not cited directly by any of the characters in the dialogue.

Each entry includes, in the heading, a brief identification of the speech and speaker and of the context in which it was spoken; given the many uncertainties, these are very broad categories (public speech, including contionesiudicia populi, funeral orations, or any other public address to a large audience; senate speeches; quaestiones, including quaestiones extraordinariae; and civil lawsuits, including cases before the centumviral court). After that, on successive lines, I have listed (a) all references to the same event in De oratore, including in parentheses the character in the dialogue who mentions it; (b) other references to the same speech, first in Cicero, then, much more selectively, in other sources (and my lists are much more selective than those in TLRR); (c) other known participants in the event; and (d) references to the speech in the standard collections (ORFTLRR), indicating when a speech ought to have been included but is not; (e) any other pertinent information. Not every entry has all categories of information, and the absence of any reference to other citations of the same speech or trial should be taken to mean that De oratore is the sole source.
