I. Speeches and trials mentioned in De oratore
The list given below contains every speech or trial mentioned in De oratore; they are arranged in order of appearance, and subsequent references to the same speech or trial are listed under their first appearance. Trials, although in some cases more than one speech is discussed, are listed as single events; somewhat inconsistently, multiple speeches given in the same senate meeting or public assembly are listed separately, because they are in general distinguished by Cicero. This applies particularly to the last senate meeting before Crassus’ death, within which Cicero distinguishes three speeches. The number of question marks and expressions of uncertainty in this list indicate that it represents an approximation and that the conclusions drawn from it (in Chapter 3, in particular) are also approximations: the numbers of various kinds of speeches, and even the identification of particular speeches, trials, and speakers are probable rather than certain. In the identification of just what kind of event is being described, Caesar Strabo’s discussion of humor poses particular difficulties: because he is reporting jokes, not arguments, it is not always easy to tell whether he is referring to a speech or simply reporting a conversational anecdote, nor is it always possible to be certain whether multiple jokes involving the same person come from the same speech. My judgment in such cases is not always the same as that of other scholars, and I have generally avoided combining separate jokes in order to construct a single speech. Aside from funny stories that seem to refer to conversational exchanges rather than speeches, I have also excluded two possible items:
a)The third—or second-century problem of the citizenship of Publicius Menander (1.182, although unnamed here; cf. Cic.Balb. 28 and Dig. 49.15.5.3); this was resolved by legislation, not a trial, and no speech is connected with it.
b)the quotations from Crassus’ speeches on the colony of Narbo and the lex Servilia (2.223); they are quotations within a quotation from the speech of M. Iunius Brutus against Crassus (see #30 below) and are not cited directly by any of the characters in the dialogue.
Each entry includes, in the heading, a brief identification of the speech and speaker and of the context in which it was spoken; given the many uncertainties, these are very broad categories (public speech, including contiones, iudicia populi, funeral orations, or any other public address to a large audience; senate speeches; quaestiones, including quaestiones extraordinariae; and civil lawsuits, including cases before the centumviral court). After that, on successive lines, I have listed (a) all references to the same event in De oratore, including in parentheses the character in the dialogue who mentions it; (b) other references to the same speech, first in Cicero, then, much more selectively, in other sources (and my lists are much more selective than those in TLRR); (c) other known participants in the event; and (d) references to the speech in the standard collections (ORF, TLRR), indicating when a speech ought to have been included but is not; (e) any other pertinent information. Not every entry has all categories of information, and the absence of any reference to other citations of the same speech or trial should be taken to mean that De oratore is the sole source.
1.Crassus’ prosecution of C. Papirius Carbo (119); quaestio
De or. 1.40 (Sc), 1.121(Cr), 2.170 (Ant), 3.74 (Cr)
also Cic. Verr. 2.3.3, Br. 159, Off. 2.47, Fam. 9.21.3; Val. Max. 6.5.6; Tacitus Dial. 34.7
ORF 66.13–14; TLRR 30
2.M. Plautius Hypsaeus against Cn. Octavius (127–6?); civil
De or 1.166–7 (Cr)
other participants in the story include M. Crassus (praetor); P. Mucius (jurist in consilium)
TLRR 22
The date is inferred from the fact that Octavius (consul 128) is called consularis while Hypsaeus (consul 125) is not.
3.Unknown speaker (91); civil
De or. 1.168 (Cr)
Crassus was in the consilium, Q. Pompeius Rufus was urban praetor.
TLRR 99
4.Unknown speaker, unknown date; disinherited soldier (thought dead); civil
De or. 1.175(Cr), 1.245 (Ant)
not in TLRR
5.Unknown speaker, unknown date; contested inheritance among the Claudii; civil
De or. 1.176 (Cr)
TLRR 364
6.Unknown speaker, unknown date; patron’s right of inheritance; civil
De or. 1.177 (Cr)
TLRR 363
7.C. Sergius Orata against M. Marius Gratidianus (unknown date); civil
De or. 1.178 (Cr)
also Cic. Off. 3.67
ORF 65.33, 66.42; TLRR 362
Orata was represented by Crassus, Gratidianus by Antonius.
8.Fufius against Buculeius (unknown date); civil
De or. 1.179 (Cr)
TLRR 361
9.Crassus (representing Coponius) against Scaevola Pontifex (representing Curius): the causa Curiana (93); civil
De or. 1.180 (Cr), 1.238 (Ant), 1.242–44 (Ant), 2.24 (Cr), 2.140–41 (Ant), 2.220 (Caes)
also Cic.Inv. 2.122, Caec. 53, 69, Br. 144–46, 195, 256, Top. 44; Quintil. 7.6.9–10
ORF 66.28–33, 67.4–6; TLRR 93
10.Postliminium of C. Hostilius Mancinus (136); civil
De or. 1.181–82 (Cr), 1.238 (Ant), 2.137 (Ant)
also Dig. 50.7.18 (Pomponius, ultimately from Q. Mucius)
not in ORF or TLRR
Mancinus’ claim to recover his citizenship through postliminium after having been surrendered to the Numantines by the fetiales was successfully opposed in the centumviral court by P. Rutilius M.f. (i.e., not Rutilius Rufus); Mancinus’ citizenship was restored by a subsequent law.
11.Unknown speaker, unknown date; at what moment does a slave become free?; civil
De or. 1.183 (Cr)
not in ORF or TLRR
12.Unknown speaker, unknown date; estate of a man with two wives; civil
De or. 1.183 (Cr)
TLRR 354
13.Crassus’ suasio legis Serviliae (106); public

also cited by M. Brutus at 2.223 in #30 below
ORF 66.22–26
14.Ser. Sulpicius Galba’s defense of his actions (149); public
De or. 1.227–28 (Ant)
also Cic. Div.Caec. 66, Mur. 59, Br. 89–90; Livy, Per. 49; Val. Max. 8.1 abs. 2 and later references.
ORF 19.12–15; TLRR 1
L. Scribonius Libo as tribune proposed a quaestio extraordinaria to try Galba for his activities in Lusitania; the proposal was defeated, although supported by Cato and L. Cornelius Cethegus. This and the next entry are not part of a trial; they are public speeches against and for Libo’s proposal. Galba in fact spoke three times in the debate, but De or. does not distinguish among them.
15.Cato against Galba de Lusitanis (149); public
De or 1.227 (Ant)
also Cic. Br. 80, 89; Val. Max. 8.1 abs. 2; Gellius 1.12.17, 13.25.15; Fronto,Ad M. Caes. 3.21.4
ORF 8.196–99; TLRR 1
See on #14 above. Cato included his speech in Origines Book 7 (FRHist 5 T13b, F107b).
16.Prosecution of Rutilius Rufus for repetundae (92); quaestio
De or. 1.229-33 (Ant)
also Cic. Br. 115, Font. 38, Pis. 95, ND 3.80; Livy, Per. 70; Velleius 2.13.2; Val. Max. 2.10.5, 6.4.4 and later references
Cotta and Scaevola Pontifex also spoke on Rutilius’ behalf.
ORF 44.3–6; TLRR 94
17.Catulus’ funeral oration for his mother Popilia (c.102?); public
De or. 2.44 (Ant)
ORF 63.5
The date is uncertain, but likely.
18.Crassus’ speech against his censorial colleague Ahenobarbus (92); public
De or. 2.45 (Ant), 230 (Ant), 242 (Caes)
also Cic. Br. 162, 164; Val. Max. 9.1.4; Pliny, NH 17.1.1–4; Suet. Nero 2.2; Aelian, HA 8.4
ORF 66.34–40
19.Antonius’ testimony against Titius (98); quaestio
De or. 2.48 (Ant), 2.253 (Caes), 265 (Caes)
ORF 65.18, 36; TLRR 80
Gruen 1966: 38 wrongly says that Antonius was prosecutor.
20.Sulpicius’ early trial speech (96); prob. civil
De or. 2.88 (Ant)
ORF 76.11; TLRR 85
Cited by Antonius to show how much Sulpicius improved before next entry, scarcely a year later. Almost certainly not the same as Sulpicius’ participation in the trial of Caepio, TLRR 88.
21.Prosecution of Norbanus for maiestas (95); quaestio
De or. 2.89 (Ant), 2.107–9 (Ant), 2.124–25 (Cr), 2.164 (Ant), 2.167 (Ant), 2.188 (Ant), 2.197–204 (Ant + Sulp)
also Cic. Part. 104–5, Off. 2.49; Apul. Apol. 66
Sulpicius prosecuted; Antonius defended; Aemilius Scaurus was a witness.
ORF 65.22–30, 76.12–15; TLRR 86
22.Prosecution of Cossii by Antonius (unknown date); civil
De or. 2.98 (Ant)
C. Scribonius Curio defended.
ORF 65.32; TLRR 360
23.Carbo’s defense of Opimius (120); public
De or. 2.106 (Ant), 2.132 (Ant), 2.134 (Ant), 2.165 (Ant), 2.169 (Ant)
also Cic. Br. 128, Part. 106; Livy, Per. 61
P. Decius Subulo (De or. 2.132) prosecuted.
ORF 35.8–11, 36.2–3; TLRR 27
24.Scipio Aemilianus’ opposition to Carbo’s law permitting repeated tribunates (131); public
De or. 2.106 (Ant)
also Cic.Mil. 8, Am. 96; Livy, Per. 59 and later sources
ORF 21.28–29
De or. refers only to Scipio’s response to an interrogatio, but it seems likely that Carbo’s question and Scipio’s famous answer (iure caesum videri) took place on the same occasion as Scipio’s speech against the lex Papiria, recorded in De amicitia and the Periocha of Livy (which makes iure caesum videri part of the speech). For a detailed account of the sources, see Astin 1967: 264–66.
25.Antonius’ defense of M’. Aquillius for repetundae (97?); quaestio
De or. 2.124 (Cr), 2.188 (Ant), 2.194–96 (Ant)
also Cic. Verr. 2.5.3; Livy, Per. 70 (Cicero eius rei solus auctor); Quintil 2.15.7
Marius was a witness; the prosecutor was L. Fufius.
ORF 65.19–21; TLRR 84
Cic. Br. 222, Off. 2.50, and Apuleius Apol. 66 do not mention Antonius and speak only of Fufius’ prosecution, ORF 75.4–6.
26.Antonius’ commiseratio for Cn. Mallius (103); quaestio
De or. 2.125 (Cr)
ORF 65.17, TLRR 64
TLRR classifies this as a iudicium populi, but Mallius was in fact tried under a quaestio extraordinaria established by a law proposed by Saturninus. This commiseratio may be part of the defense, but it is also possible that it was part of Antonius’ defense of Norbanus, as is also true for the next entry.
27.Antonius’ commiseratio for Marcius Rex (117?); probably quaestio
De or. 2.125 (Cr)
ORF 65.31; TLRR 33
See note on previous entry.
28.Prosecution of Decius Subulo (119); probably quaestio
De or. 2.135 (Ant)
also Cic. Part. Or. 104
TLRR 31
On the trial, see Badian 1956: 92–93.
29.Unknown speaker in support of recall of Metellus Numidicus (100–99); public
De or. 2.167 (Ant)
not in ORF or TLRR
The broad lists at Red. Sen. 37 and Red. Pop. 6 of those who spoke in favor of Numidicus’ recall may contain the identity of the speaker; it must be a contio, as Numidicus’ recall was never discussed in the senate. On the chronology and the problems, see Badian 1984: 130–40.
30.M. Brutus’ prosecution of Cn. Plancius (or Plancus) (90s); quaestio
De or. 2.220–26 (Caes)
also Clu. 140–41; Quintil. 6.3.44 (citing De or.)
Crassus was Planc(i)us’ advocate.
ORF 56.3–5, 66.45–47; TLRR 98
31.Catulus being questioned by Philippus (96–95); quaestio
De or. 2.220 (Caes), 2.245 (Caes), 2.249 (Caes), 2.255 (Caes)
also Quintil. 6.3.81 (from De or. 2.220)
ORF 70.15–17, TLRR 90, 359
TLRR 90 believes that all these references concern the same occasion, but TLRR 359 assigns De or. 2.245 to a separate trial. I assume only one case. Gruen’s attempt (1966: 49–50) to create from this a prosecution of Philippus by Hortensius for repetundae after an alleged praetorship in Africa is highly imaginative, but we do not know either the date or location of Philippus’ praetorship, and while Hortensius is known to have spoken in the forum and in the senate in 95, he is not known to have undertaken any prosecution. TLRR 90 assumes that this must be the same case as #56 below, but that speech is explicitly said to be in the senate.
32.Crassus speaking against Memmius (111 or later); public
De or. 2.240 (Caes), 264 (Caes), 267 (Caes)
ORF 66.20–21
33.Scipio Africanus replying to charges of M. Naevius (187); public, apparently iudicium populi
De or. 2.249 (Caes)
also Livy 38.56.1–5, 39.52.3; Gellius 4.18.3–6
ORF 4.3–5 (omitting this passage)
34.Aemilius Scaurus speaking to Italians (before 95); presumably public
De or. 2.257 (Caes)
Not in ORF. This anecdote clearly comes from a speech, but its context is entirely unknown.
35.Antonius speaking against Coelius (undated); quaestio
De or. 2.257 (Caes)
ORF 65.35, TLRR 83
It is unclear whether Antonius was an advocate or the defendant himself; the charge is clearly ambitus. TLRR identifies this with the prosecution of Antonius by Duronius in 97–96 (#41); there is no reason to do so.
36.Civil suit of C. Visellius Aculeo against M. Marius Gratidianus (undated); civil
De or. 2.262 (Caes), 269 (Caes)
ORF 66.43–44, TLRR 366
Aculeo was represented by Crassus, Gratidianus by L. Aelius Lamia.
37.Prosecution of Piso (possibly L. Calpurnius Piso, consul 112) for repetundae (114 or 111–110); quaestio
De or. 2.265 (Caes)
The anecdote involves an exchange between one Gallus and Aemilius Scaurus, who was presumably Piso’s advocate.
TLRR 48 combines this anecdote with one at 2.285 (#46 below) and a story in Valerius Maximus 8.1 abs. 6 to create one complex trial in which no detail other than the name “Piso” is common to all three sources. There is no reason to combine them, and I have kept them separate.
38.Caesar Strabo and Helvius Mancia (after 102); quaestio
De or. 2.266 (Caes)
also Quintil. 6.3.38 (from Cicero). Pliny NH 35.25 ascribes the joke to Crassus rather than Caesar Strabo.
ORF 73.15; not in TLRR
39.Caesar Strabo and a witness named Pinarius (unknown); prob. quaestio
De or. 2.266 (Caes)
not in ORF or TLRR
40.Scipio Aemilianus’ reply to Ti. Claudius Asellus’ prosecution (140); public
De or. 2.268 (Caes)
also Aulus Gellius 2.20.5–6, 3.4.1, 4.17.1 (quoting Lucilius 394M), 6.11.9
ORF 21.18–22; TLRR 6
This speech (there were actually five; see below) appears to be separate from the anecdote at De or. 2.258 which took place during the recognitio equitum during Scipio’s censorship (142–141); cf. Astin 1967: 256. Gellius 3.4.1 gives his source as in libris, quos de vita P. Scipionis Africani compositos legimus; at 2.20.6 he quotes ex oratione eius contra Claudium Asellum quinta. Cicero may have used such a source, but we have no clear evidence.
41.Duronius’ prosecution of Antonius for ambitus (97–96); quaestio
De or. 2.274 (Caes)
also Val. Max 2.9.5
TLRR 83 (but see on #35 above).
42.Aemilius Scaurus’ prosecution of Rutilius Rufus for ambitus (116); quaestio
De or. 2.280 (Caes)
also Cic. Br. 113
ORF 43.3–4; TLRR 35
The companion prosecution (Rutilius accusing Scaurus) is only mentioned in Br.
43.T. Albucius’ prosecution of Scaevola Augur for repetundae (119); quaestio
De or. 2.281 (Caes), 3.171, quoting Lucilius (Cr)
also Cic. Br. 102, Orat. 149 (quoting Lucilius), Fin. 1.9 (quoting Lucilius); Lucilius 55–94M
ORF 50 and 64 give only testimonia; TLRR 32
The trial was included at some length in Book 2 of Lucilius’ Satires; only De or. 2.281 and Br. 102 refer to the actual trial.
44.Memmius’ prosecution of Calpurnius Bestia under the Mamilian Law (109); quaestio
De or. 2.283 (Caes)
ORF 60.5; TLRR 54
45.Prosecution of Scipio Nasica by M. Fulvius Flaccus (132); quaestio
De or. 2.285 (Caes)
ORF 38.5; TLRR 18
The story appears to concern the selection of senatorial iudices for a special quaestio concerning the death of Ti. Gracchus; there was probably no speech at all, as Nasica was sent off on an embassy and died abroad.
46.Crassus’ defense of Piso (undated); quaestio
De or. 2.285 (Caes)
ORF 66.49; TLRR 48
See on #37 above.
47.Sulpicius as advocate (undated; prob. before 95); quaestio
De or. 2.305 (Ant)
not in ORF or TLRR
It is possible but not necessary that this anecdote refers to the trial of Norbanus.
48.Funeral oration for Scipio Aemilianus written by Laelius (129); public
De or 2.341 (Ant)
also Cic. Mur. 75; Schol. Bob. in Mil. 118.11–17St.
ORF 20.22–23
This passage reports that the speaker was Q. Aelius Tubero; the other sources (probably correctly) identify the speaker as Q. Fabius Maximus Allobrogicus.
49.Philippus’ attack on the program of Livius Drusus (Sept. 91); public
De or. 3.2 (Cic)
also Val. Max. 6.2.2 (for #49, 52, and 53 clearly drawing on De or.)
ORF 70.10
De or. 1.24 does not appear to refer to this particular speech.
50.Speech of Livius Drusus against Philippus (Sept. 91); senate
De or. 3.2 (Cic)
ORF 72.7
51.First speech of Crassus against Philippus (Sept. 13, 91); senate
De or. 3.3 (Cic)
ORF 66.41
52.Philippus reply to Crassus (Sept. 13, 91); senate
De or. 3.4
also Val. Max. 6.2.2
Not in ORF
53.Last speech of Crassus (Sept. 13, 91); senate
De or. 3.4–6
also Val. Max. 6.2.2; Quintil. 8.3.89, 11.1.37
ORF 66.41
ORF conflates Crassus’ two speeches in the senate: he spoke both before and after Philippus.
54.C. Fannius’ speech de sociis et nomine Latino against C. Gracchus’ citizenship legislation (122); public
De or. 3.183 (Cr)
also Cic. Br. 99–100; Julius Victor 402.12H; Charisius 181.15–16B; Priscian, Ars 8.16
ORF 32.1–5
55.C. Gracchus’ last speech (121); public
De or. 3.214 (Cr)
also Quintilian 11.3.115, Julius Victor 443.3H (both from Cicero)
ORF 48.61
56.Hortensius’ speech on behalf of the Afri (95); senate
De or. 3.229 (Cr)
ORF 92.13; TLRR 90.
As noted above (#31), this was not a trial speech.
57.Hortensius’ speech pro Bithyniae rege (95); public
De or. 3.229 (Cr)
also Cic. Br. 229
ORF. 92.14
Br. 229 refers to an unidentified speech delivered by Hortensius in foro . . . et apud . . . consules in 95; this is likely to refer to this speech (not to #56, which was in the senate) and thus to locate and date it.
II. Speeches and trials 149–91
These are arranged in chronological order, with speeches for which we have only an approximate date listed under the earliest likely date. Descriptions are necessarily very brief; more information is to be found in ORF and TLRR. Entries of the form “DO #1” refer to the first list above; “other Cic” means works of Cicero other than De oratore, and “other” means that the speech is attested in non-Ciceronian sources.
